I wouldn't want to make it more complicated than that. Rules about 
conflict resolution, for example, open the door for one party to swamp 
the moderator (who is just a volunteer) with pages and pages of text. 
The moderator should not be required to endure a never-ending argument, 
and one party can always claim that all his points haven't been heard 
properly. The person being expelled could send 10 pages of explanations 
to the moderator and then say "the moderator cut me of fwhen I still had 
so much more to say!".

A simple rule like "no personal attacks allowed" is best. If the list 
disagrees with how the rule was applied (whether there was a personal 
attack, who is at fault, whether there was proper warning, etc) the list 
can approach the moderator about the issue.
