I think Alex is following a circular proof. Let me give an analogy.
You want to have a party in the street. For the whole neighborhood. You 
have to get permission from the police to shut down the street for the 
afternoon, by law.
Now, in order to have the party you not only need a good date and drinks 
and all that, but also a piece of paper with permission.

The mistake in logic I see Alex making is that the only reason he thinks 
you need permission is because there exists a piece of paper giving you 
permission. Kinda.
